5.7  Travel dates are fixed as 9 June 2027 to 20 June 2027 (or the nearest dates on which the Promoter can reasonably re-book substantially the same itinerary if a supplier cannot confirm the original dates). The prize cannot be taken at any other time. If the winner or companion is unable or unwilling to travel on the prize dates, the prize will be forfeited and a redraw conducted under clause 8.

5.8  The Promoter will endeavour to book the hotels and experiences named in clause 5.3. If any component cannot be secured due to availability, weather, operational, safety or other circumstances outside the Promoter’s reasonable control, the Promoter may substitute a hotel, transfer, tour or experience of similar value and standard. Glacier helicopter flights, boat cruises and alpine activities are weather and operator dependent and may be delayed, rerouted or replaced with an alternative experience. No cash compensation is payable for a substituted or unused component.

5.9  The winner and companion must be medically and physically fit to undertake light walking, a boat cruise and, if they participate, a helicopter glacier experience. Participation in any activity is subject to the operator’s terms, safety briefings, weight and health restrictions and weather decisions. The Promoter is not liable if an operator refuses carriage or participation.

5.10  The prize is not transferable, not exchangeable and not redeemable for cash or any other prize, except that the Promoter may, in its absolute discretion, substitute a prize (or any part of a prize) with another prize of equal or greater value if the advertised prize becomes unavailable for any reason beyond the Promoter’s reasonable control.

5.11  Any unused portion of the prize is forfeited and no compensation will be paid.

5.12  Once tickets and land arrangements have been issued they are subject to the airline’s and suppliers’ conditions, including change and cancellation fees. Airfares are generally non-refundable once issued.

5.13  The itinerary is supplied through a third-party travel intermediary (including Helloworld Travel Menai / Journey South or such other agent as the Promoter appoints). The winner and companion must accept the agent’s and suppliers’ terms. The Promoter is not the operator of airlines, hotels or tour services.

6. Draw

6.1  The prize winner will be determined by a random electronic draw of all valid entries.

6.2  The draw will be conducted at 12:00pm AEDT on Tuesday 9 March 2027 using the government-certified TPAL Electronic Draw System operated at randomdraws.com.au by Trade Promotions and Lotteries Pty Ltd (ACN 601 297 330), or another random method permitted by NSW Fair Trading.

6.3  The draw will be conducted at the Promoter’s office at Shop 49B/A 345 Victoria Ave, Chatswood Chase Shoppping Centre, Chatswood, NSW 2067 or, if conducted wholly online through randomdraws.com.au, the location of the draw is the Promoter’s registered office.

6.4  The first valid entry drawn will win the prize. Additional entries may be drawn and reserved, in order, as contingency winners in case the first drawn winner is ineligible, cannot be contacted or does not claim the prize.

6.5  The Promoter’s determination of the winner, including any decision that an entry is invalid, is final. No correspondence will be entered into except as required by law.

6.6  The Promoter will retain draw records, including the Random Draws certificate or equivalent audit report, for a period of at least 12 months after the draw (or longer if required by law) and will produce them to NSW Fair Trading on request.

7. Winner notification and publication

7.1  The Promoter will use all reasonable efforts to notify the winner by telephone and/or email within two (2) business days of the draw, using the contact details linked to the winner’s Zero Specialty account and/or Instagram account.

7.2  The winner must respond and provide any requested verification (identity, citizenship, age, proof of purchase, companion details and signed prize acceptance) within ten (10) business days of the first notification attempt.

7.3  The Promoter may publish the winner’s first name, last initial and postcode on www.zerospecialty.com.au and on the Promoter’s Instagram account within 14 days of the winner being confirmed, and may keep that notice available for at least 28 days. By entering, each entrant consents to that limited publication.

7.4  If the Promoter wishes to use the winner’s full name, image, Instagram handle or likeness in advertising, it will first obtain the winner’s written consent. Consent to publicity is not a condition of receiving the prize, except for the limited publication in clause 7.3.

7.5  If there is no prize winner, or the prize winner cannot be found after the claim period and any redraw, the Promoter will publish that fact on www.zerospecialty.com.au within 14 days.

8. Prize claim period, unclaimed prize and redraw

8.1  The prize must be claimed by 5:00pm AEST on Wednesday 9 June 2027 (three months after the original draw), or such earlier date as is reasonably required to issue tickets for a 9 June 2027 departure (Claim Period). The Promoter may set an earlier practical claim deadline and will tell the winner that deadline when notifying them.

8.2  The Promoter will make every reasonable effort to contact the winner during the Claim Period, including at least two telephone attempts and two email attempts on separate days.

8.3  If the prize is not claimed within the Claim Period, or the drawn winner is ineligible, cannot be verified, declines the prize, or cannot travel on the prize dates, the prize will be forfeited and the Promoter will conduct an unclaimed prize redraw.

8.4  The unclaimed prize redraw will be conducted at 12:00pm AEST on Wednesday 9 June 2027 (or the next business day if that date is a public holiday) in the same manner as the original draw, from the remaining valid entries. The redraw winner will be notified by telephone and/or email within two (2) business days and published in the same manner as clause 7.3.

8.5  If the redraw winner does not claim the prize within seven (7) days of notification, or cannot travel, the Promoter may continue to draw reserved entries until the prize is awarded or it becomes impracticable to deliver the travel components. The Promoter is not required to keep the prize longer than three months after the original draw.

9. Winner and companion obligations

9.1  It is the winner’s and companion’s sole responsibility to obtain and hold, at their own cost, all passports, visas, NZeTA and other authorities required to enter and leave New Zealand and to re-enter Australia. The Promoter is not responsible if travel cannot proceed because documents are missing, refused or delayed.

9.2  The winner must sign a prize acceptance form, liability release and (if requested) a publicity consent, and must procure the companion’s signature on equivalent documents, before the prize is released.

9.3  The winner must provide the Promoter with full legal names (as shown on passports), dates of birth, passport details, contact details and any information reasonably required by airlines or suppliers, within five (5) business days of request.

9.4  The Promoter may refuse to award the prize if it reasonably believes that awarding it would be unlawful, unsafe, or contrary to the integrity of the Promotion.

10. Verification and invalid entries

10.1  The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age, citizenship, account ownership, Instagram ownership and proof of purchase) and to disqualify any entrant who:

(a)    tampers with the entry or draw process;

(b)    submits an entry that is not in accordance with these Terms;

(c)    engages in conduct that is misleading, harassing, or contrary to the spirit of the Promotion; or

(d)    is otherwise ineligible.

10.2  Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any right is not a waiver of that right.

11. Privacy

11.1  The Promoter collects personal information in order to conduct the Promotion, to verify entries, to award the prize, to publish the winner as required, and for related record-keeping. If the requested information is not provided, the entry may be invalid.

11.2  Personal information will be handled in accordance with the Privacy Act 1988 (Cth) and the Promoter’s privacy policy at www.zerospecialty.com.au/privacy-policy. That policy explains how to access or correct personal information and how to complain.

11.3  The Promoter may disclose personal information to its contractors (including Random Draws / TPAL, the travel agent, hotels, airlines and tour operators), to NSW Fair Trading if requested, and otherwise as required or authorised by law.

11.4  By entering, an entrant consents to the Promoter using their personal information for future marketing from Zero Specialty. An entrant may opt out at any time by emailing hello@zerospecialty.com.au or using the unsubscribe facility. Opting out of marketing does not affect an otherwise valid entry.

12. Liability

12.1  Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded (Non-Excludable Rights).

12.2  Except for Non-Excludable Rights, and to the maximum extent permitted by law, the Promoter (including its officers, employees and agents) is not liable for any loss, damage, personal injury, death, cost or expense arising from:

(a)    participation in the Promotion;

(b)    acceptance or use of any prize, including travel, accommodation, transfers, glacier, helicopter, boat, walking or wine-tasting activities;

(c)    weather, volcanic, seismic, industrial, pandemic, airline or supplier disruption;

(d)    lost, stolen or damaged tickets or documents; or

(e)    any tax liability incurred by a winner.

12.3  Without limiting clause 12.1, the Promoter’s liability for a breach of a Non-Excludable Right is limited, where permitted, to the re-supply of the relevant service or payment of the cost of re-supply.

12.4  The Promoter is not responsible for any tax implications. Independent financial advice should be sought.

13. Changes, cancellation and force majeure

13.1  If any aspect of the Promotion is not capable of running as planned because of war, terrorism, pandemic, natural disaster, government restriction, technical failure, or any other cause beyond the Promoter’s reasonable control, the Promoter may cancel, terminate, modify or suspend the Promotion, or invalidate affected entries, subject to the direction of NSW Fair Trading and any other relevant regulator.

13.2  Any change to these Terms will be published on www.zerospecialty.com.au. The Promoter will take reasonable steps to notify participants, or will make the change publicly available within a reasonable time before it takes effect. If the Promotion requires an authority, any substantial change will also be notified to NSW Fair Trading.

13.3  If the Promotion is conducted in additional Australian States or Territories, the Promoter will obtain any further permit required and will add the permit number to advertising.

14. Disputes

14.1  A person who has a complaint about the Promotion should first write to the Promoter at hello@zerospecialty.com.au setting out the issue and the outcome sought. The Promoter will acknowledge the complaint within five (5) business days and will use reasonable efforts to resolve it within fifteen (15) business days.

14.2  If the dispute is not resolved, either party may refer the matter to NSW Fair Trading (fairtrading.nsw.gov.au or 13 32 20) or to the courts of New South Wales.

14.3  These Terms are governed by the laws of New South Wales. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales.

15. General

15.1  A reference to a statute includes that statute as amended or replaced and any subordinate legislation.

15.2  If any provision of these Terms is invalid or unenforceable, it may be severed and the remaining provisions continue in force.

15.3  These Terms record the entire agreement between the Promoter and each entrant about the Promotion.

15.4  The Promoter’s decisions about the conduct of the Promotion are final, subject to the Community Gaming Act 2018 (NSW), the Australian Consumer Law and the dispute process in clause 14.

16. Permit and advertising statement

16.1  Authorised under NSW permit number TP/05192.
